Limited Warranty

Your new Zoybar kit (the “Product”) is warranted by Zoybar to be free from defects in material and workmanship for a period of one year from the date of purchase (the “Warranty Period”).
Zoybar, at its option, will either repair or replace the Product, or refund the purchase price of the Product, in each case only if the Product is properly returned to Zoybar during the Warranty Period in accordance with the Zoybar Return Policy and the Product is found to be defective. If choosing to replace the Product, Zoybar may furnish a refurbished unit or a unit that would not be sold as “new” merchandise.

ZOYBAR WARRANTS SOLELY TO THE ORIGINAL PURCHASER THAT THE PRODUCT PURCHASED DIRECTLY FROM ZOYBAR WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP WHEN USED WITHIN THE LIMITS SPECIFIED ON THE WEBSITE FOR A PERIOD OF ONE (1) YEAR FROM DATE OF RECEIPT.
THE EXCLUSIVE REMEDY AND ZOYBAR’S ENTIRE LIABILITY UNDER THIS LIMITED WARRANTY, WILL BE FOR ZOYBAR, AT ITS OWN DISCRETION TO (I) REPAIR THE DEFECTED PART OF THE PRODUCT, OR (B) REPLACE THE DEFECTED PART OF THE PRODUCT WITH A REASONABLY AVAILABLE EQUIVALENT NEW OR REFURBISHED PART. IN ANY CASE OF MALFUNCTION, ZOYBAR WILL NOT REPLACE THE WHOLE PRODUCT, BUT THE DEFECTED PART THEREOF ONLY. ANY REPAIRED OR REPLACED PARTS WILL BE WARRANTED FOR THE REMAINDER OF THE ORIGINAL WARRANTY PERIOD OR FOR THIRTY (30) DAYS, WHICHEVER IS LONGER.
THIS LIMITED WARRANTY DOES NOT APPLY IF: (A) THE PRODUCT HAS NOT BEEN OPERATED, USED, REPAIRED, OR MAINTAINED IN ACCORDANCE WITH ZOYBAR'S INSTRUCTIONS, (B) THE PRODUCT HAS BEEN ALTERED OR MODIFIED, EXCEPT BY ZOYBAR, (C) THE PRODUCT HAS BEEN SUBJECTED TO ABNORMAL PHYSICAL OR ELECTRICAL STRESS, ABUSE, MISUSE, NEGLIGENCE, OR ACCIDENT, (D) THE PRODUCT DAMAGE WAS CAUSED BY USE WITH NON-ZOYBAR PRODUCTS, OR (E) THE PRODUCT IS SUPPLIED FOR BETA, EVALUATION, PROMOTIONAL, TESTING OR DEMONSTRATION PURPOSES FOR WHICH ZOYBAR DOES NOT CHARGE A PURCHASE PRICE.
ALL FUNCTIONS PROVIDED BY ZOYBAR WITH THE PRODUCT, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, ZOYBAR DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, THE INABILITY TO USE, OR THE RESULTS OF THE USE OF THE PRODUCT, INCLUDING IN CONNECTION WITH ANY tax or customs laws and regulations in your state of residence, OR ANY OTHER APPLICABLE LAWS AND REGULATIONS, AND IN CONNECTIONS WITH SHIPMENT AND STORAGE CONDITIONS.

WHAT IS NOT COVERED
DAMAGE TO THE PRODUCT RESULTING FROM ACCIDENT, FIRE, FLOOD, OR OTHER NATURAL DISASTERS, MISUSE, ABUSE, UNAUTHORIZED SERVICE, IMPROPER VOLTAGE OR POWER SUPPLY, OR VIOLATION OF THE CARE AND USE INSTRUCTIONS WRITTEN ABOVE, WILL VOID THIS LIMITED WARRANTY.

This Limited Warranty is valid only for the original consumer with proof of purchase, the recipient of the original consumer. The Limited Warranty is not transferable. No Limited Warranty service is available without proof of purchase. The Limited Warranty does not apply to any non-Zoybar hardware product, any consumables (such as batteries), or any documentation or software code, even if installed on, or packaged or sold with, the Zoybar hardware.
No Zoybar reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

Our Customer Service team will gladly assist you to identify and fix the problems you have experienced. If, despite this effort, you and The Zoybar Team cannot together resolve the problem, Zoybar will issue you a Return Material Authorization code. Please return your Product to the address your Customer Service Specialist will provide you and include your Return Material Authorization code with your package and refer to it in any subsequent communications.
If Zoybar determines that your Product has suffered a failure under the Limited Warranty, a repaired or replaced unit will be sent to you without cost. If your Product is found to be outside the Warranty Period or is otherwise not covered under the Limited Warranty, Zoybar will return it to you at your expense.
PLEASE DO NOT RETURN YOUR PRODUCT WITHOUT A RETURN MATERIAL AUTHORIZATION CODE as it will not be accepted and will be returned to you at your expense. Zoybar will not, under any circumstance, furnish you a repaired or replaced Product prior to its receipt of your original product. The retail vendor from whom your Product was purchased does not have any authority to vary the terms of this Limited Warranty.
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES (INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY, AND EXCEPT FOR THE LIMITED WARRANTY CONTAINED HEREIN, THE PRODUCT IS PROVIDED “AS IS AND WITH ALL FAULTS”.
UNDER NO CIRCUMSTANCES WILL ZOYBAR BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHETHER OR NOT THE PRODUCT IS FOUND TO BE COVERED BY THIS LIMITED WARRANTY. This Limited Warranty gives you specific rights, and you may also have other rights that vary from state to state.
In the event of a defect, to the extent permitted by law, these are your sole and exclusive remedies.
This Limited Warranty shall be governed by the laws of the State of Israel without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.
